Terms of Service
Welcome to Questly. These Terms of Service ("Terms") govern your use of the Questly mobile applications, websites, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
1. Eligibility
You must be at least 13 years old (or 16 in jurisdictions where that's the minimum age for digital consent without parental authorisation) to use Questly. By using the Service, you confirm that you meet this requirement and that the information you provide is accurate.
2. Your account
You're responsible for activity that happens on your account and for keeping your sign-in credentials confidential. Notify us at support@questly.games if you suspect your account has been accessed without your permission.
3. Your content
You retain ownership of the content you create on Questly (lists, reviews, scores, comments, profile content). By submitting content to the Service you grant Questly a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and distribute it to the extent necessary to operate the Service.
You're responsible for your content. You agree not to post content that is illegal, infringing, defamatory, harassing, hateful, sexually explicit, or otherwise violates these Terms or our community guidelines. We may remove content that violates these Terms at our discretion.
4. Acceptable use
You agree not to:
- Use the Service for unlawful purposes or to harm others.
- Attempt to gain unauthorised access to the Service, other accounts, or our infrastructure.
- Use automated tools to scrape, copy, or harvest data from the Service.
- Impersonate any person or misrepresent your affiliation with anyone.
- Interfere with or disrupt the Service or the experience of other users.
- Resell or commercially exploit any part of the Service without our written permission.
5. Premium features
Some features are available as part of a paid subscription ("Questly Pro"). Subscriptions are billed by the platform you purchased on (Apple App Store, Google Play) and are subject to that platform's terms. You can manage or cancel your subscription through the platform's account settings.
6. Intellectual property
The Service — including its software, design, logos, and content not submitted by users — is owned by Questly or its licensors and is protected by intellectual-property laws. Game cover art, titles, and metadata are the property of their respective publishers; Questly displays them under fair use for the purpose of cataloguing and recommendation.
7. Termination
You can delete your account at any time in Settings → Account → Delete account. We may suspend or terminate accounts that violate these Terms, abuse the Service, or pose a security risk. Sections that by their nature should survive termination (intellectual property, disclaimers, limitations of liability) will survive.
8. Disclaimers
The Service is provided "as is" and "as available." We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Recommendations and scores reflect the views of users and Questly's algorithms and are not a guarantee of personal enjoyment.
9. Limitation of liability
To the maximum extent permitted by law, Questly will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill arising out of or related to your use of the Service. Our total liability for any claim related to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the claim, or (b) USD 50.
10. Indemnity
You agree to defend and indemnify Questly against any claim brought by a third party arising out of your use of the Service, your content, or your violation of these Terms.
11. Changes to the Service or these Terms
We may modify the Service or these Terms from time to time. When we change these Terms materially we'll update the "Last updated" date and notify you in-app or by email. Continued use of the Service after a change means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules. To the extent permitted by law, any dispute will be resolved in the courts of England and Wales. This does not affect mandatory consumer rights you have under the laws of the country where you live.
